This Returns and Refunds Policy applies to purchases made from Basketball Witch, operated by FASFIN d.o.o., Gradišče nad Prvačino 57b, 5292 Renče, Slovenia.
This policy is intended for consumer purchases. If you purchase as a business, different rules may apply unless mandatory law provides otherwise.
1. Right of Withdrawal for EU Consumers
If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by a clear statement, for example by email or by post.

You may use the model withdrawal form included at the end of this policy, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your notice of withdrawal before the 14-day withdrawal period has expired.
2. Returning the Product After Withdrawal
After informing us of your withdrawal, you must send back the product without undue delay and no later than 14 days from the day on which you informed us of your decision to withdraw from the contract.

We may provide additional return instructions to help process your return, but your right of withdrawal is not conditional on receiving prior approval from us.
3. Right of Withdrawal vs Defective or Non-Conforming Products
The right of withdrawal applies when you return a product within 14 days of receiving it, without giving any reason.
If the product is defective, damaged, incorrect, or not as described, separate statutory consumer rights apply under applicable consumer protection law. These rights may include the right to request repair, replacement, price reduction, or refund, depending on the situation and applicable law.
This policy does not limit your statutory consumer rights.
4. Exceptions to the Right of Withdrawal
Under Article 16 of Directive 2011/83/EU, the right of withdrawal may not apply to certain categories of products and services.
Basketball Witch products sold through this store are standard physical products intended for active play, unless clearly stated otherwise before purchase.
If personalized Shooting Spot Markers, custom engravings, made-to-order custom editions, or digital content are offered in the future, additional withdrawal limitations may apply only where permitted by applicable law. Any such limitation will be clearly stated before purchase.
5. Return Conditions for Withdrawal
You may inspect the product as you would in a physical store to establish its nature, characteristics, and functioning.
If the product has been handled beyond what is necessary to inspect its nature, characteristics, and functioning, we may reduce the refund to reflect any loss in value caused by such handling.
To help us process your return, please return the product:
- with all parts originally delivered, where reasonably possible;
- in its original packaging, where reasonably possible;
- without damage caused by misuse, improper use, or unauthorized modification.
Failure to return the original packaging does not automatically remove your right of withdrawal. However, it may affect the assessment of the returned product if the product is damaged, incomplete, or has lost value due to handling beyond what is necessary to inspect it.
6. Return Shipping Costs
When exercising the right of withdrawal, you are responsible for the direct cost of returning the product, unless otherwise required by applicable law.
If the product is defective, damaged, incorrect, or non-conforming, we will cover the necessary return shipping costs where the claim is justified under applicable consumer law.
We recommend using a tracked shipping service when returning products. When exercising the right of withdrawal, you are responsible for ensuring that the returned item is sent back safely.
7. Refunds After Withdrawal
If you withdraw from the contract within the applicable withdrawal period, we will reimburse all payments received from you, including the cost of standard delivery.
We are not required to reimburse additional delivery costs if you chose a delivery method other than the least expensive standard delivery option offered by us.
We will reimburse you within 14 days from the day on which we are informed of your decision to withdraw from the contract.
We may withhold reimbursement until we have received the returned goods or until you have supplied evidence of having sent back the goods, whichever is earlier.
Refunds will be made using the same payment method used for the original transaction, unless expressly agreed otherwise.
No additional fee will be charged by us for issuing the refund.
8. Damaged, Defective, Incorrect, or Non-Conforming Products
If you receive a damaged, defective, incorrect, or non-conforming product, please contact us as soon as possible at info@basketballwitch.com.
Please include your order number and, where relevant, photos of the product and packaging. Photos help us assess the issue faster, but they do not limit your statutory rights.
Under applicable EU consumer law, you may be entitled to remedies for non-conforming goods for a period of 2 years from delivery.
Depending on the situation and applicable law, the remedy may include replacement, repair where appropriate, price reduction, or refund at no additional cost to you.
For customers in Slovenia, if a lack of conformity appears within 14 days of delivery, additional rights may apply under Slovenian consumer protection law, including the right to reject the goods where applicable.
This section does not limit your statutory consumer rights.
9. Situations Where a Refund May Be Reduced
Refunds related to the right of withdrawal may be reduced where the product has lost value due to handling beyond what is necessary to inspect its nature, characteristics, and functioning.
This may include, for example:
- damage caused by misuse or improper use;
- unauthorized modification or alteration after delivery;
- returning the product incomplete without justification;
- use beyond what is necessary to inspect the product.
This does not affect your statutory rights for defective, damaged, incorrect, or non-conforming goods.
10. Exchanges
We currently do not offer direct exchanges.
If you wish to exchange an item, please return the original product in accordance with this policy and place a new order.
If the product is defective, damaged, incorrect, or non-conforming, your statutory consumer rights apply independently of this exchange policy.
11. Product Use, Active Play, and Normal Wear
Basketball Witch products are designed for active play by children aged 6+ under appropriate supervision and in accordance with the product instructions.
Normal cosmetic wear, surface marks, or minor cosmetic changes resulting from ordinary and expected use are not considered defects, provided that the product remains safe, functional, and compliant with the product description.
Damage caused by misuse, improper use, intentional damage, unauthorized modification, or use contrary to the product instructions may not be treated as a product defect.
This does not affect your statutory rights if the product is defective, damaged, incorrect, unsafe, or not as described.
